Ever s.r.l., with registered office in Treviso, viale della Repubblica no. 209 and operating office in Pramaggiore (VE), via Pacinotti no. 37, as the controller for the processing of personal data (hereinafter “Controller” or “EVER”), is issuing this information to the subject filmed (hereinafter “Data subject”) in compliance with European and Italian laws on the protection of personal data (privacy) and laws on the protection of copyright (Law 633/1941) and on the abuse of other people’s images (art. 10 Italian Civil Code).
Legal basis and purpose of processing
The Controller processes the data to create promotion, commercial and brand communication campaigns. The legal basis for processing is provided by Data Subject consent and the image is considered as usable – for that purpose – free of charge.
The Controller undertakes not to prejudice the personal dignity and decorum of the subjects filmed.
Data retention period
The Controller will retain the data for the promotional campaign validity period or for as long as it is needed to keep the content active in the areas where it will be published, as long as no previous request to revoke consent should occur. In one of these circumstances, the Controller will erase the data from all digital media and paper when it has the potential and autonomous control to do so. However, it might be possible, related to the different platform (Facebook, LinkedIn, YouTube) use conditions, for other users to share and/or re-share data making it impossible to completely remove the personal data collected and published.
Nature of data provision and the consequences of refusal to provide data
Providing data is optional and if not provided the Controller cannot perform any promotional activities requiring use of the personal data of the Data Subject.
The Controller intends to circulate the data collected. During the data collection and processing period, in particular image data, processing will only be permitted to internal parties authorised to process data due to their jobs, and to companies or professionals who collect the image data, process and publish them; consultancy firms when setting up trade fairs, companies handling the adaptation, paging and printing of paper media and IT service companies on the systems used to process the data.
After they have been published in areas accessible to the public, the personal data can be processed by any user navigating the company website, by any person taking part in events or trade fairs that the Controller takes part in and users registered on the platforms where the company has registered an official account.
For further information on terms regulating use of data in the platforms we use would you kindly read the following documents:
Transfer of data to a third country and/or an international organisation
The controller intends to process the personal data, before they are circulated, on technological supports or paper archives located in the European Economic Area. However, it should be specified that, related to the circulation process for which specific consent is required, it is not possible to establish whether the data will suffer processing in third, non-European countries.
Rights of the data subjects
Data subjects have the right to ask the Controller to access their personal data and rectify any inaccuracies, to erase them or limit processing if conditions are applicable, to object to processing for legitimate interests pursued by the Controller, and to obtain the portability of data provided personally, only if processed automatically based on consent or on the contract.
Data subjects also have the right to revoke consent given for processing purposes requiring it, with no prejudice to the legality of processing performed until it is revoked.
